What Are Bankruptcy Unclaimed Funds?

During a bankruptcy case, funds may be distributed to creditors, claimants, businesses, individuals, or other legally entitled recipients. When a distribution cannot be delivered — or is never negotiated — the money may be deposited with the bankruptcy court and held until an eligible recipient claims it.

Why funds may remain undistributed

  • The recipient moved and the court had an outdated address.
  • A check was issued but never cashed.
  • A business closed, dissolved, merged, or changed its name.
  • The recipient died before the distribution was completed.
  • Records identified the recipient inconsistently.

Why documentation matters

Bankruptcy courts generally require documentation establishing who the claimant is and why that claimant is entitled to the specific funds held in the case. Requirements and procedures can vary from one bankruptcy court to another, and certain filings may need to be made by a licensed attorney.

A separate process from state unclaimed property

Bankruptcy unclaimed funds are held by a federal bankruptcy court and follow court procedures. State-held unclaimed property is administered by a state program under different rules. The two are not interchangeable and are handled separately.
